1. DEFINITIONS  

1.1 “Auction” means the process by which items are sold to the highest bidder.  1.2 “Auctioneer” means the person or entity conducting the auction.  

1.3 “Bid” means the amount offered by a user to purchase an item.  

1.4 “Item” means any object, product, or service that is available for purchase through the auction.  1.5 “User” means any person who uses or accesses the website. 

1.6 “Shipping” refers to the process of transporting goods or products from one location to another. It  involves the physical movement of goods by land, sea, or air, and can include various stages such as  packing, handling, loading, and unloading. 

2. ELIGIBILITY  

2.1 To participate in the auction, users must be 18 years of age or older.  

2.2 Users must also agree to pay a mandatory, non-refundable fee to participate in the auction. 

3. AUCTION RULES  

3.1 The auction will be conducted in accordance with the rules established by the auctioneer.  3.2 All bids are binding and cannot be retracted.  

3.3 The auctioneer reserves the right to reject any bid or to withdraw any item from the auction at any  time.  

3.4 The auctioneer’s decision is final and binding.  

3.5 The auctioneer reserves the right to cancel or postpone the auction at any time. 

4. BIDDING PROCESS  

4.1 Users must register and provide accurate and complete information to participate in the auction. 4.2 Users must also provide valid payment information to participate in the auction.  4.3 Users can bid on an item by submitting their bid through the website.  

4.4 The highest bidder at the end of the auction will be the winner. 

4.5Bid Increments: The Auctions are conducted using a bidding system. Each Auction will have a specified  starting bid and bidding increments. You may place a bid on an Auction by entering the amount you wish  to bid and clicking the “bid” button. Once you place a bid, it cannot be retracted or canceled. We reserve  the right to set bid increments for any auction. Bid increments are the minimum amount by which bids  must be raised during the auction. The bid increment will be clearly stated in the auction listing. 

4.6 Auction End Time. Each auction on our platform will have a specified end time. Bids received after the  end time will not be accepted.

4.7 Reserve Price. We reserve the right to set a reserve price for any auction. The reserve price is the  minimum price that we are willing to accept for the product being auctioned. If the highest bid at the end  of the auction does not meet the reserve price, the product will not be sold. 

5. PAYMENT AND SHIPPING 

If your bid is the highest bid at the close of the Auction, you will be the winner of the Auction. You will  be notified of your winning bid by email. The winning bidder must pay the full amount of their bid, plus  any applicable taxes and fees, within. You must pay the total amount due for the Auction, including any  applicable taxes and fees, within 24 hours of the close of the Auction. Failure to pay within this  timeframe may result in the cancellation of your bid and the re-listing of the item. 

5.1 24 hours of the end of the auction.  

5.2 Payment must be made through the website using the payment method provided by the auctioneer.  5.3 We will arrange for shipping of the item to the winning bidder address provide on the website.  5.4 We offer free shipping for all items winning in our auctions inside. 

5.5 The winning bidder is responsible for any additional shipping or handling fees as an insurance or  others. 

5.6 One-Time Fee. To participate in any auction on our platform, you must pay a one-time fee of $2.50.  This fee is non-refundable and must be paid in full at the time of registration. This fee covers the cost of  administering the auction platform and is subject to change without notice. 

5.6 Free Shipping Eligibility: Free shipping is only available for orders shipped within the United States.  International orders will be subject to shipping charges. 

Exclusions: Some products or categories may be excluded from the free shipping offer. This may include  heavy or oversized items, hazardous materials, or products that require special handling. International shipping charges: International shipping charges will be calculated based on the  destination country and shipping method selected. Customers are responsible for all customs duties,  taxes, and fees associated with international orders. 

Delivery time: Free shipping orders may take longer to arrive than paid shipping orders. Delivery times  may vary depending on the shipping method and destination. 

Returns: Free shipping offers may not apply to returns. Customers are responsible for return shipping  costs and any associated fees. 

6. DISPUTES 

6.1Dispute Resolution: Any dispute, claim, or controversy arising out of or relating to this agreement or  the breach, termination, enforcement, interpretation or validity thereof, including the determination of  the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in  accordance with the rules of the Arbitration.  

6.2 Notification of Dispute: In the event of a dispute, the affected party shall notify the other party in  writing within 30 days of the dispute arising. The notice shall include a detailed description of the  dispute and the remedy sought. 

6.3 Cooperation: Both parties agree to cooperate fully in the resolution of any dispute and to provide all  relevant information and documents necessary for the resolution of the dispute. Attorneys’ Fees and Costs: In the event of any dispute arising under this agreement, the prevailing party  shall be entitled to recover all costs and reasonable attorneys’ fees incurred in connection with the  dispute.

6.4 Limitation of Liability: We shall not be liable for any indirect, special, consequential, or punitive  damages, or any lost profits or lost revenues, arising out of or relating to this agreement or the use of  our website, even if we have been advised of the possibility of such damages. 

6.5 Modifications: We reserve the right to modify these terms and conditions at any time, and such  modifications shall be effective immediately upon posting on our website. Your continued use of our  website after any such modifications shall constitute your agreement to be bound by such modified  terms and conditions. 

7. INTELLECTUAL PROPERTY  

7.1 The website and all content, trademarks, and other intellectual property contained therein are  owned or licensed by the auctioneer.  

7.2 Users may not use any content or intellectual property of the auctioneer without the express written  consent of the auctioneer. 

8. LIMITATION OF LIABILITY  

8.1 The auctioneer shall not be liable for any damages or losses, including but not limited to direct,  indirect, incidental, special, or consequential damages, arising out of or in connection with the auction  or these terms and conditions.  

8.2 The auctioneer’s liability shall be limited to the amount of the winning bid. 

9. INDEMNIFICATION  

9.1 Users agree to indemnify and hold harmless the auctioneer, its affiliates, and their respective  officers, directors, employees, and agents from any claims, damages, or losses arising out of or in  connection with the user’s use of the website or participation in the auction.  

9.2 This indemnification shall include, without limitation, reasonable attorneys’ fees. 

10. FRAUDULENT ACTIVITY 

We take fraudulent activity very seriously and will not tolerate any attempts to manipulate our auctions.  If we suspect that you are engaging in fraudulent activity, we may cancel your bids, suspend your  account, or take legal action against you. We reserve the right to investigate any suspicious activity and  report it to the appropriate authorities. 

11. OWNERSHIP AND COPYRIGHT 

All content and materials on our Services, including but not limited to text, graphics, logos, images, and  software, are the property of PENTAIRON and are protected by United States and international  copyright laws. You may not use, reproduce, modify, distribute, or display any content or materials on  our Services without our prior written consent. 

12. USER CONDUCT 

You agree to use our Services only for lawful purposes and in a manner consistent with this agreement  and all applicable laws and regulations.  

12.1 You may not use our Services to: 

Post or transmit any content that is unlawful, threatening, abusive, defamatory, obscene, or otherwise  objectionable; engage in any activity that could damage, disable, overburden, or impair our Services; Interfere with the security or integrity of our Services or any user’s account;

Use any robot, spider, or other automated means to access our Services or collect information from our  Services; Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a  person or entity.
